Terms of Service

1. Agreement to These Terms

These Terms of Service are a legally binding agreement between you and Sports Business Ventures LLC, doing business as Sports Business Ventures and SBV, referred to in these Terms as "SBV," "we," "us," or "our."

SBV operates sportsbusinessventures.com and related websites, platforms, memberships, communities, newsletters, job boards, directories, coaching programs, events, and other products and services that link to these Terms, collectively, the "Services."

By accessing, registering for, purchasing, subscribing to, applying through, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

Additional terms may apply to a particular product, program, event, engagement, purchase, staffing opportunity, or business relationship. If a separate written agreement conflicts with these Terms, the separate agreement will control for the specific services it covers.

2. Eligibility and Accounts

The Services are generally intended for individuals who are at least 18 years old and legally capable of entering into a binding agreement.

Individuals under 18 may participate only when expressly authorized by SBV through an approved school, university, parent, guardian, employer, or other program, and when any required consent has been obtained.

When creating an account or using the Services, you agree to:

  • Provide accurate, current, and complete information.
  • Keep your account information updated.
  • Protect your password and login credentials.
  • Notify SBV promptly if you believe your account has been compromised.
  • Accept responsibility for activity conducted through your account, except where unauthorized activity results from SBV's failure to use reasonable security measures.

You may not impersonate another person or organization, create an account using false information, access another person's account without permission, or create accounts through unauthorized automated methods.

SBV may suspend, restrict, or terminate an account that violates these Terms, creates security or legal concerns, remains unpaid, or disrupts the Services or other users.

3. Our Services

SBV provides sports business education, career development, professional networking, advisory, recruiting, staffing, event operations, media, and related services.

The Services may include:

  • The Playbook and other memberships or subscription products.
  • Job boards, directories, job alerts, and career-opportunity listings.
  • Coaching, mentorship, informational interviews, and professional-development programs.
  • University, student-athlete, employer, and institutional programs.
  • Newsletters, webinars, reports, guides, templates, courses, and other educational resources.
  • Strategic advisory, consulting, project management, partnership development, and operational support.
  • Recruiting, candidate sourcing, screening, staffing, scheduling, and workforce coordination.
  • Event staffing, event operations, activation support, and related services.
  • Advertising, employer promotion, sponsorship, branded content, and partnership services.
  • Other products, programs, and services offered by SBV.

We may add, modify, suspend, restrict, or discontinue parts of the Services, subject to applicable law and any separate written agreement.

4. Business, Advisory, and Staffing Engagements

SBV may work with companies, brands, teams, leagues, universities, events, agencies, nonprofit organizations, and other partners to provide advisory, consulting, recruiting, staffing, event operations, project management, partnership development, or other business services.

These engagements may be governed by a separate proposal, statement of work, order form, services agreement, staffing agreement, insertion order, or other written agreement.

Any separate agreement will control over these Terms regarding matters such as:

  • Scope and deliverables.
  • Fees and payment terms.
  • Staffing responsibilities.
  • Worker classification and supervision.
  • Confidentiality.
  • Intellectual property.
  • Insurance.
  • Cancellation and termination.
  • Performance standards.
  • Responsibilities of each party.

Unless expressly agreed in writing, SBV does not guarantee any particular revenue result, partnership, sponsorship, placement, hire, employee retention, attendance level, project result, or other business outcome.

The responsibilities of SBV, a client, an event operator, a worker, or another party will depend on the applicable written agreement, the facts of the engagement, and applicable law.

An introduction, recommendation, recruitment, scheduling, or coordination by SBV does not by itself establish that an individual is an employee, contractor, agent, or representative of SBV.

5. Purchases and Payments

Certain Services require payment.

By making a purchase, you authorize SBV and its third-party payment processors to charge your selected payment method for the price, applicable taxes, and any other charges disclosed before purchase.

Unless otherwise stated:

  • Prices are displayed in United States dollars.
  • Payment is required before access or services are provided.
  • You are responsible for keeping your billing information current.
  • SBV may correct pricing, billing, or description errors.

SBV may reject or cancel transactions involving suspected fraud, misuse, unauthorized resale, payment failure, or pricing errors.

If SBV cancels a purchase after collecting payment and does not provide the purchased Service, SBV will provide an appropriate refund or credit.

Payments may be processed by third-party providers that maintain their own terms and privacy policies.

6. Subscriptions, Renewals, and Cancellation

Certain Services may be offered through monthly, annual, or other recurring subscriptions.

Before purchase, SBV will disclose the material subscription terms, including the price, billing frequency, renewal period, and cancellation method.

By enrolling in a recurring subscription, you authorize SBV and its payment processors to charge your selected payment method at the disclosed billing frequency until you cancel.

Unless otherwise stated, subscriptions automatically renew for periods equal to the original subscription period.

Promotional, introductory, or discounted pricing may apply only during the stated promotional period. After that period, the subscription may renew at the then-current price disclosed to you.

SBV will provide renewal reminders, price-change notices, and other subscription notices when required by applicable law.

You may cancel using the cancellation method available through your account, purchase confirmation, or the Contact Us link in the footer of our website.

Unless otherwise stated:

  • Cancellation prevents future renewal charges.
  • Cancellation takes effect at the end of the current paid period.
  • Access continues through the end of the current paid period.
  • Partial billing periods are not prorated or refunded.
  • Unsubscribing from marketing communications does not cancel a paid subscription.
  • Deleting an account or discontinuing use does not automatically cancel a subscription.

Nothing in these Terms limits any cancellation right provided by applicable law.

7. Refunds and Rescheduling

Unless a different policy is presented at the time of purchase, payments are final and nonrefundable, except where required by law or where SBV does not provide the purchased Service.

Separate cancellation, refund, credit, or rescheduling terms may apply to:

  • Coaching or mentorship sessions.
  • Memberships and subscriptions.
  • Events and webinars.
  • Digital products and educational materials.
  • University or institutional programs.
  • Advertising and sponsorship services.
  • Staffing, recruiting, and advisory engagements.
  • Consulting and project-based services.

Any terms presented during checkout, booking, registration, or contracting are incorporated into these Terms.

SBV may provide a refund, credit, replacement session, or other accommodation in its discretion. Providing an accommodation in one situation does not require SBV to provide the same accommodation in another.

8. Coaching, Mentorship, and Educational Content

SBV may provide coaching, mentorship, career-development support, networking opportunities, informational interviews, webinars, newsletters, directories, and educational materials.

These Services are intended for general educational and professional-development purposes. They do not constitute legal, financial, medical, mental-health, tax, investment, immigration, or other regulated professional advice.

SBV does not guarantee that participation will result in:

  • Employment or an internship.
  • An interview or job offer.
  • Admission to a school or program.
  • A promotion or compensation increase.
  • A partnership or business opportunity.
  • An introduction to a particular person or organization.
  • Any specific career or professional outcome.

Results depend on many factors outside SBV's control, including participant effort, experience, qualifications, employer decisions, market conditions, timing, and availability.

Mentors, coaches, speakers, contributors, and community members may express their own views. Those views do not necessarily represent SBV or any organization with which that person is affiliated.

You are responsible for independently evaluating information and deciding whether to act on it.

9. Scheduled Sessions and Events

Coaching sessions, mentorship sessions, interviews, webinars, events, and other scheduled activities may be subject to additional attendance, cancellation, rescheduling, lateness, and no-show policies.

You are responsible for:

  • Confirming the correct date, time, and time zone.
  • Attending through the designated platform or location.
  • Maintaining the technology and internet access needed to participate.
  • Providing reasonable notice when cancellation or rescheduling is permitted.
  • Conducting yourself professionally and respectfully.

SBV may reschedule, replace, or reassign a coach, mentor, speaker, interviewer, staff member, or event representative when reasonably necessary.

SBV may remove a participant from a session, event, or program for harassment, discrimination, threats, unsafe conduct, disruption, or other violations of these Terms.

10. Job Listings and Career Opportunities

SBV may operate job boards, directories, or other platforms through which employers, recruiters, event operators, and other third parties publish or promote jobs, internships, projects, fellowships, staffing roles, volunteer positions, and other professional opportunities.

Unless a listing expressly identifies SBV as the hiring or engaging organization, SBV is not the employer or contracting party for the opportunity.

SBV does not guarantee:

  • The accuracy or completeness of a listing.
  • That an opportunity remains available.
  • That every employer or opportunity has been independently verified.
  • That an employer will review or respond to an application.
  • That an applicant will receive an interview or offer.
  • The compensation, classification, safety, working conditions, or legality of a third-party opportunity.
  • The identity, conduct, financial condition, or reliability of an employer, recruiter, or applicant.

Users are responsible for independently evaluating opportunities and organizations before applying, accepting work, traveling, or sharing sensitive information.

You should not send money, banking information, government identification, tax information, or other sensitive information unless you have independently verified the organization and determined that the request is legitimate and appropriate.

SBV may review, edit, reject, suspend, or remove a listing at any time.

11. Employer and Recruiter Responsibilities

Employers, recruiters, event operators, and organizations using the Services agree that their listings, communications, and hiring practices will:

  • Be accurate, current, and not misleading.
  • Fairly describe the opportunity and material requirements.
  • Include compensation information when required by law.
  • Comply with employment, labor, wage, worker-classification, privacy, accessibility, advertising, and anti-discrimination laws.
  • Not request unlawful fees or payments from applicants.
  • Not promote scams, pyramid schemes, deceptive opportunities, or unlawful activities.
  • Not misuse, sell, or improperly disclose applicant information.
  • Not use applicant information for unrelated marketing without appropriate consent.
  • Not impersonate another organization or individual.

Employers and engaging organizations are responsible for their hiring, interviewing, onboarding, compensation, supervision, workplace, and employment decisions, except where a written agreement expressly assigns a responsibility to SBV.

12. Applications and Staffing Opportunities

When you submit an application or express interest in an opportunity through the Services, you authorize SBV to share the information and materials you provide with the employer, client, recruiter, event operator, or organization associated with that opportunity.

Application information may include your:

  • Name and contact information.
  • Resume and employment history.
  • Education and qualifications.
  • Availability and location.
  • Travel capabilities.
  • Work authorization information.
  • Responses to application questions.
  • Portfolio, social-media profile, or professional links.
  • Other information you voluntarily provide.

You are responsible for ensuring that your application materials are accurate, truthful, current, and lawful to share.

Applying, interviewing, receiving an initial communication, or being identified as a potential candidate does not guarantee selection and does not create an employment or contractual relationship.

A work relationship is created only when the applicable parties complete a final written offer, agreement, onboarding process, or other binding arrangement.

Specific staffing or event terms may address:

  • Dates and hours.
  • Compensation and payment timing.
  • Travel, lodging, meals, and reimbursements.
  • Credentials and venue access.
  • Dress code and conduct.
  • Training and onboarding.
  • Worker classification.
  • Supervision and performance.
  • Cancellation or removal.

Unless expressly stated in writing, SBV does not guarantee reimbursement of travel, lodging, meals, transportation, parking, or other expenses.

13. Job Alerts and Communications

Users may be able to receive job alerts, staffing opportunities, program information, newsletters, event updates, application communications, and other messages.

Job and opportunity alerts may be based on profile information, preferences, location, activity, prior interactions, or automated systems.

SBV does not guarantee that:

  • Every alert will be relevant.
  • Every matching opportunity will be included.
  • A listed opportunity will remain available.
  • Alerts will be delivered immediately or without error.

You are responsible for reviewing the full listing before applying or taking action.

By providing your email address or phone number and opting into communications, you consent to receive messages from SBV as permitted by law. Communications may include:

  • Account and security notices.
  • Billing and subscription notices.
  • Job and staffing alerts.
  • Application or interview updates.
  • Event and program information.
  • Session reminders.
  • Newsletters and promotional communications.
  • Customer-support messages.

Marketing consent is not a condition of purchase unless expressly disclosed and permitted by law. Message and data rates may apply.

You may unsubscribe from promotional emails using the link included in the message. You may opt out of text messages by following the instructions provided in the message.

Opting out of marketing messages will not prevent SBV from sending transactional, billing, account, legal, security, or service-related communications.

14. Acceptable Use

You may use the Services only for lawful and intended purposes.

You may not:

  • Violate any law, regulation, court order, or third-party right.
  • Harass, threaten, stalk, discriminate against, or harm another person.
  • Post defamatory, obscene, fraudulent, hateful, or unlawful content.
  • Misrepresent your identity, qualifications, affiliation, experience, or authority.
  • Send spam, mass solicitations, or unauthorized promotions.
  • Collect, disclose, sell, or misuse another person's information.
  • Record private sessions or conversations without any consent required by law.
  • Scrape, crawl, harvest, copy, or systematically retrieve data without written permission.
  • Build a competing database, directory, mailing list, candidate list, or service using SBV data or Content.
  • Use SBV Content or data to train or improve an artificial-intelligence or machine-learning system without written permission.
  • Circumvent paywalls, access restrictions, security measures, or usage limits.
  • Reverse engineer, decompile, disassemble, or attempt to discover source code.
  • Introduce malware, viruses, malicious code, or harmful technology.
  • Interfere with or place an unreasonable burden on the Services.
  • Attempt to gain unauthorized access to an account, server, system, or network.
  • Engage in payment fraud, chargeback abuse, or unauthorized purchasing.
  • Resell, sublicense, distribute, or commercially exploit the Services without written permission.
  • Encourage or assist another person in engaging in prohibited conduct.

SBV may investigate suspected violations and may remove content, restrict access, suspend accounts, cancel listings, or report unlawful conduct to the appropriate authorities.

15. Intellectual Property

The Services and materials owned or licensed by SBV are protected by intellectual-property laws.

This includes website and platform designs, software, databases, directories, articles, newsletters, reports, videos, photographs, graphics, courses, coaching materials, templates, frameworks, presentations, trademarks, logos, and other content, collectively, "SBV Content."

Subject to your compliance with these Terms, SBV grants you a limited, personal, nonexclusive, nontransferable, and revocable license to access and use SBV Content for your own lawful, noncommercial purposes.

You may not copy, reproduce, publish, distribute, sell, license, publicly display, modify, create derivative works from, or commercially exploit SBV Content without written permission.

Purchasing or accessing paid Content does not transfer ownership of that Content to you.

16. User Content and Feedback

You may be able to submit resumes, profiles, photographs, comments, reviews, application materials, documents, recordings, messages, links, or other content, collectively, "User Content."

You retain ownership of your User Content.

By submitting User Content, you grant SBV a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and use that content as reasonably necessary to:

  • Operate and provide the Services.
  • Display your profile or submissions as directed by you.
  • Share application materials with organizations connected to an opportunity.
  • Administer programs, communities, events, and communications.
  • Protect the security and integrity of the Services.
  • Comply with law and enforce these Terms.

You represent that you own or have permission to submit your User Content and that it does not infringe another person's rights, violate the law, contain malicious code, or include information you are not authorized to share.

SBV may remove or restrict User Content that violates these Terms or creates legal, security, safety, or operational concerns.

If you voluntarily provide ideas, recommendations, or feedback about the Services, SBV may use that feedback without restriction or compensation. This does not apply to confidential information protected by a separate written agreement.

SBV will not use private User Content as a standalone commercial endorsement without permission, unless the content was submitted for promotional use or a separate agreement allows it.

17. Third-Party Services and Content

The Services may link to or integrate with third-party websites, employers, payment processors, scheduling platforms, video-conferencing services, community platforms, social-media services, advertisers, and other providers.

SBV does not control and is not responsible for third-party:

  • Terms or privacy practices.
  • Products or services.
  • Content or availability.
  • Security or data practices.
  • Statements or representations.
  • Transactions, hiring decisions, or contractual relationships.

Your use of a third-party service is subject to that provider's terms and policies.

A link, integration, advertisement, listing, introduction, or mention does not necessarily constitute SBV's endorsement of the third party.

The Services may also contain advertisements, sponsorships, employer promotions, affiliate links, or branded content. Advertisers and sponsors are responsible for their products, services, claims, and legal compliance.

18. Privacy

SBV's collection, use, disclosure, and protection of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that you have reviewed the Privacy Policy.

You may not use personal information obtained through the Services for unauthorized marketing, scraping, resale, harassment, discrimination, identity theft, or any unlawful purpose.

19. Suspension, Termination, and Service Changes

You may stop using the Services at any time. Stopping use does not automatically cancel a paid subscription or eliminate payment obligations already incurred.

SBV may suspend, restrict, or terminate access if:

  • You violate these Terms.
  • You fail to pay amounts owed.
  • Your conduct creates safety, legal, security, or reputational risk.
  • Your use disrupts the Services or other users.
  • SBV is required to do so by law or a third-party provider.
  • The applicable Service is discontinued.

SBV may modify, update, suspend, or discontinue any part of the Services.

SBV does not guarantee that the Services will always be available, uninterrupted, secure, complete, or error-free. Availability may be affected by maintenance, third-party outages, software failures, telecommunications issues, security incidents, emergencies, or circumstances outside SBV's reasonable control.

20. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SBV DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

SBV DOES NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • INFORMATION OR CONTENT WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT.
  • THE SERVICES WILL MEET YOUR EXPECTATIONS.
  • A JOB, INTERNSHIP, BUSINESS, COACHING, NETWORKING, STAFFING, ADVISORY, OR PARTNERSHIP OPPORTUNITY WILL PRODUCE A PARTICULAR RESULT.
  • A THIRD-PARTY EMPLOYER, CLIENT, USER, MENTOR, ADVERTISER, OR PROVIDER WILL PERFORM AS EXPECTED.

You are responsible for your decisions, applications, purchases, travel, professional interactions, employment decisions, hiring decisions, and participation in opportunities.

Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SBV AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages for lost profits, lost revenue, lost opportunities, lost data, business interruption, reputational harm, or the cost of substitute services, even if SBV has been advised that such damages may occur.

To the fullest extent permitted by law, SBV's total liability arising from or relating to the Services or these Terms will not exceed the greater of:

  • The amount you paid directly to SBV for the applicable Service during the 12 months before the event giving rise to the claim; or
  • One hundred United States dollars.

These limitations do not apply to liability that cannot legally be limited or excluded.

22. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SBV and its members, managers, officers, employees, contractors, representatives, affiliates, and agents from claims, losses, damages, liabilities, penalties, costs, and reasonable attorneys' fees arising from:

  • Your use or misuse of the Services.
  • Your violation of these Terms.
  • Your User Content.
  • Your violation of another person's rights.
  • Your violation of applicable law.
  • A listing, application, advertisement, opportunity, or representation you submit.
  • Your employment, recruiting, hiring, staffing, workplace, or business conduct.

This section does not require you to indemnify SBV for SBV's own unlawful conduct, gross negligence, or willful misconduct where prohibited by law.

23. Dispute Resolution and Arbitration

Before beginning formal legal proceedings, you and SBV agree to attempt to resolve the dispute informally for at least 30 days.

A written dispute notice must describe the nature of the dispute, the relevant account or transaction, and the requested resolution. Notices to SBV may be submitted through the Contact Us link in the footer of our website.

Except for claims that qualify for small-claims court or seek emergency injunctive relief, disputes arising from these Terms or the Services will be resolved through final and binding individual arbitration administered by the American Arbitration Association under its applicable rules.

The Federal Arbitration Act governs this arbitration provision.

Arbitration may be conducted by video, telephone, written submissions, or in person, as permitted by the applicable rules.

To the fullest extent permitted by law, disputes must be resolved individually. Neither you nor SBV may bring or participate in a class, collective, consolidated, mass, or representative action or arbitration.

You and SBV each waive the right to a jury trial for disputes subject to arbitration.

You may opt out of this arbitration provision by submitting written notice through the Contact Us link in the website footer within 30 days after first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you are opting out of arbitration.

Nothing in this section prevents either party from:

  • Bringing an individual claim in small-claims court.
  • Seeking emergency or temporary injunctive relief.
  • Protecting intellectual-property rights.
  • Reporting conduct to a government agency.
  • Exercising rights that cannot legally be subject to arbitration.

24. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where federal law or the mandatory law of another jurisdiction applies.

Any legal proceeding not subject to arbitration must be brought in the state or federal courts located in Maricopa County, Arizona. You and SBV consent to the jurisdiction and venue of those courts.

25. Changes to These Terms

SBV may update these Terms from time to time.

When changes are made, SBV will update the "Last updated" date. Where required by law, SBV will provide additional notice or request renewed consent.

Changes will apply from their effective date. Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms, except where another form of consent is required by law.

26. General Terms

These Terms, our Privacy Policy, applicable purchase or booking terms, and any separate written agreement between you and SBV constitute the entire agreement regarding the applicable Services.

SBV's failure to enforce a provision is not a waiver of that provision.

If any provision is found to be unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in effect.

You may not assign your rights or obligations under these Terms without SBV's written consent. SBV may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the applicable business or Service.

SBV will not be responsible for a delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disasters, public-health emergencies, government actions, transportation disruptions, venue closures, telecommunications failures, cyberattacks, or third-party outages.

These Terms do not create a partnership, joint venture, agency, franchise, fiduciary, or employment relationship between you and SBV.

Headings are provided for convenience and do not limit the meaning of any provision. The word "including" means "including without limitation."
